<p style="text-indent: 22pt; line-height: 200%"><font color="#333333"><P>随着乔森潘的被捕，红色高棉在世的五位高官相继要被送上“种族灭绝罪行国际法庭”，他们将被以反人类罪起诉，柬埔寨之前的屠杀历史将以法律诉讼的方式被清理。正如柬埔寨首相洪森所说，是“柬埔寨人民和国际社会期待已久的”。尽管红色高棉的倒台已过去了1/4个世纪，但对其成员的审判仍然具有重要的意义。</P>
<P>刚刚过去不久的20世纪，是两大极权主义－－法西斯极权主义和斯大林式极权主义－－肆虐人类的世纪。而柬埔寨的红色高棉正是后者在东南亚地区的变种。它的危害性、残暴性和恐怖性，远远超过了后者。1970年代，在红色高棉统治不到4年的短短时间里，共有100万人惨遭屠杀，而当时柬埔寨的总人口数只有 700万。据学者程映虹研究，“红色高棉的大屠杀不是为了解决种族、部落或者宗教冲突，而是为了彻底重构社会。这种彻底重构又是在它汲取了国际共产主义运动的经验之后，企图在革命胜利之初就一举解决所有现实的和被其他国家的历史证明将来会产生的问题，建立一个比苏联、中国和越南都更为纯粹的社会主义社会。为了达到这个目的，它拒绝尝试任何和平改造或者说服教育的方法，取消任何过渡时期，选择了一条最简单直接的道路：从一开始就用暴力大规模地、有组织地消灭一部分人口，以此来达成社会改造。”（程映虹：《以革命的名义－－红色高棉大屠杀研究》，见秋风《思想评论》网站）。理想主义和激进主义从来就是一对孪生子，过头的理想主义伴随而来的必然是丧失理性的激进主义－－这是一切极权主义、尤其是斯大林式极权主义与身俱来的顽疾。由联合支持的特别法庭审判红色高棉，可以促使世界人民更好地反思充满着建构主义、理想主义和激进主义的斯大林式极权主义在20世纪给人类带来的深重灾难，从而在新的世纪警惕这一灾难的重演。</P>
<P>由联合国参与的、带有国际性质的法庭审判红色高棉，从弘扬“人权高于主权”理念的角度来说，意义深远。红色高棉屠杀的只是本国人民和具有本国国籍的华裔、越南裔、老挝裔和泰裔。从传统的国际法观念来看，这乃是一国之内政，而非国际法的管辖范围。何况，红色高棉也并没有侵略别国的领土、屠杀别国的人民。但随着人权时代的来临，人权已突破国界而成为一种绝对权利。侵略他国领土并践踏他国人权的行为固然应该受到国际法的惩处，但本国统治者践踏本国人权的行为，同样也应该受到国际法的惩处。而从近几十年来世界各国的现状来看，践踏人权的主体往往是来自国内残暴的统治者。这种状况在极权主义的国度尤甚。因而，国际社会对此现象不可能袖手旁观，而应该担当起捍卫不论是哪一个国度的每一个个体人权的重任。此次组建带有国际性质的法庭审判红色高棉，使得“人权高于主权”的原则由自然法进入到了实在法的层面。如果说，在科索沃事件中，执行“人权高于主权”原则只是诉诸国际警察机制的话；那么，这一次则是更深一步地启动了国际司法机制。那些在本国屠杀人民、将人民驱离家园、虐待人民、剥夺人民财产的极权主义者，不仅要被国际警察用暴力擒拿，更应该被推向正义审判台。由国际社会审判红色高棉，是“人权高于主权”理念的重大胜利。</P>
<P>尽管柬埔寨首相洪森说审判红色高棉是“国际社会期待已久的”，国际社会某些曾经支持过红色高棉的极权国家企图阻止公审的进行。尽管如此，柬埔寨国会还是终于顶住了压力，批准了与联合国达成审判红色高棉的协议和相关法律。几年来，人权意识逐渐觉醒的向往民主、自由的柬埔寨的年轻一代，搜集了大量的红色高棉大屠杀的证据，为即将开始的审判作充分的准备。我想，红色高棉决不是站在法庭上受到正义审判的最后一批极权主义者；那些仍然在自己的国内不断侵犯本国人民人权的极权主义者们，是不是还想步红色高棉的后尘？</P>
