<p style="text-indent: 22pt; line-height: 200%"><font color="#333333">上海访民童国菁控告前公安部部长周永康一案被驳回，引起外界普遍关注。童国菁将于日内寄出上诉状，向北京高级法院提出上诉。对于北京中级法院裁定书上将被告由前公安部部长周永康变更为现任公安部部长孟建柱，童国菁表示难以理解，他批评这是法院“技术性”处理为周永康脱罪，坚持要继续告周永康。
<P></P>与此同时，童国菁的诉讼代理人郑恩宠近日接连遭到上海公安传唤，继8日被传唤后，11日又被传唤了八小时。有公安扬言，接到上级通知，只要郑出家门一步，就马上传唤他，每次传唤八小时。郑恩宠批评上海当局以“耍无赖方式” 阻止他们上诉。
<P><B>法院沉默更换被告 周永康金蝉脱壳</B>
<P>童国菁12日接受大纪元访问时说，这几天彻夜和代理人郑恩宠律师研究诉状，目前诉状大致写好，准备星期三向北京第二中级人民法院寄出上诉状，由北京中院转给高级法院。
<P>对于北京中级法院在未通知原告情况下，偷偷将被告由前公安部部长周永康变更为现任公安部部长孟建柱，童国菁表示难以理解。他说，“从司法角度上，他们换人应该事先告知我，而公安部部长的人事变动已经发生了近一个月，他们都一直没有发出通知，这显示法院对法律的不尊重，对人权的不尊重，把老百姓不放在眼里。”
<P>他质疑法院通过这种技术性的处理为周永康脱罪。“这个案件曝光后，社会各界反应相当强烈，周永康现在升官了，可能当局认为再这样把他弄在被告席上不体面，就不顾司法程序把他换掉。”
<P><B>坚持告周永康讨公道</B>
<P>但童国菁强调，自己肯定会坚持告周永康，因为这是周任职期内发生的事情，周肯定要承担法律责任。“他没有管理好公安部，在任期间发生那么多访民被打被伤的事件，作为本案他应该负主要责任。你换人不能解决这个问题。”
<P>郑恩宠律师认为，北京中级法院在更换被告上的确违反了程序。“他们应该首先通知原告，我要求变更，你是否同意？第二，要通知周永康的代理人，因为裁定书上法院已经列明了周永康委托了代理人作出答辩，现在换成孟建柱，那孟建柱也应该重新出示一份新的委托书，或者变更委托书。” 他强调会在上诉中提出这一点，要求周永康负法律责任。
<P><B>中院把球踢给高院</B>
<P>北京市第二中级人民法院行政裁定书（编号：2007二中行初字第585号）驳回童国菁起诉的理由是，公安部已经在06年3月10日作出行政复议终止通知书，是公安部在另一行政程序的行政复议决定，不符合行政覆议法的范围，郑恩宠指这个裁定完全不符合逻辑。“童告公安部行政不作为，公安部来个行政复议终止，等于给你宣判一个死亡通知，但为何死亡又不告诉你，这怎么是作为了呢？”
<P>他认为，在案件曝光后，北京中级法院作了一个技术处理，把这个难题推给了北京高级法院。“到底公安部讲的对，还是童国菁讲的对，北京第二中级法院没有将童国菁一棍子打死，十天内提出上诉，让北京高级法院去裁定。”
<P><B>上海帮恐慌接连传唤郑恩宠</B>
<P>临近上诉期限，郑恩宠接连遭到上海公安不寻常的骚扰，和以往不同的是，公安似有备而来，纯粹就是要关押他，限制他的人生自由。11日晚间郑恩宠接受大纪元采访时，讲述了11日被传唤的经过。当天早上他和太太蒋美丽准备去教堂作礼拜，一出家门即被社区警察陈福培，吴群，曹福金等共四人阻拦外出，郑坚持外出，陈就急呼公安支援。六点五十五分，在郑夫妇快走到教堂时，一名叫史金荣的国保开了一辆车牌为沪B21291的警车，出具了一份空白的传唤证，将郑传唤到闸北区公安局二楼，至下午近三点钟才释放。
<P>郑恩宠表示，诧异的是，八小时的传唤过程没有人审问他，全部都是让他坐冷板凳。郑恩宠质疑守候他的两名社工作为社工没有资格传唤他，又没有穿警服，对方竟称：“是我们上级不让我们穿警服的，我们吃共产党的饭。”
<P>其后两名社工告诉郑，“从现在开始，我们接到上级通知，只要你出家里大门，我们马上传唤你，每次传唤八小时。”
<P>因为上诉期限有限，郑恩宠质疑他们用这种耍无赖的方法阻止童案上诉。“他们是在消耗我的时间，侵犯我们公民诉讼的权力。我现在和童联络都很不方便，如果一出门就关八小时，对我们研究诉状和寄出信件都存在问题。”
<P><B>孟建柱和上海帮关系密切</B>
<P>据知，除了郑恩宠被骚扰外，曾公开表示申请去北京法院旁听的上海八名访民8日也遭到公安不同程度的骚扰。对于上海帮为何这么恐慌周永康被诉案，郑恩宠认为，是因为这状诉讼案暴露出上海公安到北京截访、打伤上海访民的恶性事件，上海帮吴志明、刘云耕等人自然害怕被揭发出来，所以极力阻止这宗案件进行下去。
<P>他还透露现任公安部部长孟建柱和上海帮有很深的渊源，孟建柱担任上海市委副书记期间被认为是“小黄菊” ，是黄菊一手培植的“接班人” ，只是后来被江泽民看中，被调任江西省任省委书记。<FONT color=#ffffff>(</FONT></P></font></td>
