<p style="text-indent: 22pt; line-height: 200%"><font color="#333333"><P align=center><A href="/news2/upimg/uploadimg/20071110/065220938.jpg" target=_blank><IMG height=300 alt="" src="/news2/upimg/uploadimg/20071110/065220938.jpg" width=212 border=1></A> <BR><FONT color=#8b0000 size=2>上海访民童国菁状告前公安部部长周永康行政不作为，九月底获北京第二中级人民法院正式受理，<BR>引起外界的广泛关注。十一月七日他接到法院来信，北京第二中级法院在未开庭情况下将案件驳回。</FONT></P>
<P>11月8日被上海闸北区公安传唤的上海维权律师郑恩宠，已于当日下午被释放。在得知上海访民童国菁告周永康案件被北京中级法院驳回的消息后，郑恩宠表示很失望，他指出案件未开庭即遭驳回，是违反法定程序的，是中共法制的倒退，他估计是现任政治局常委周永康在背后施压，胡温妥协的结果。</P>
<P>上海访民童国菁状告周永康，被北京第二中级法院正式立案的消息，10月30日经本报率先披露后，在海内外引起很大的反响。外界关注法院何时正式开庭，也有不少上海访民和市民等致信法院要求开庭旁听。有分析认为，法院能够正式立案，是胡江内斗白热化的表现。</P>
<P><STRONG>法院驳回起诉 被告由周永康变为孟建柱</STRONG></P>
<P>童国菁8日接受本报查询时表示，已经于7日收到北京第二中级人民法院5日的信件，以“不符合行政复议法有关规定”为由驳回起诉。同时，信件中引述公安部的答辩状，被告已经由前公安部部长周永康变更为现任公安部部长孟建柱。</P>
<P>童国菁对法院的驳回感到失望，表示会谘询有关法律意见后，在法律规定的十天内向北京高等法院提出上诉。</P>
<P><STRONG>郑恩宠指驳回裁决违反法律程序</STRONG></P>
<P>童国菁的法定代理人之一郑恩宠律师8日晚得知此消息后，表示会尽快和童国菁研究法院的裁定书，提出上诉。他表示，第二中级法院是一审法院，按照规定法院不可以书面审，应该要开庭，现在未开庭就先行裁定是严重违反了法律。“童国菁06年提出诉讼，法院按规定7天内要作出是否接受立案的答覆，但北京第二中级人民法院整整花了一年时间才立案，已经违反了法律程序，现在未开庭又裁决，是错上加错。”</P>
<P>对于被告突然由周永康更改为孟建柱，郑恩宠律师也感到诧异。他说，如果是要更改被告，按照规定，法院会先向原告发出通知指当事人变更代理人。但现在没有提出变更，但裁决书上就自动变更，是非常奇怪的一种做法。</P>
<P>他强调，这个案件意义重大，童国菁能够告进去，是了不起的，一方面是他本人恒心和耐心努力的结果，另一方面也给众多访民一个希望。无论结果如何，他们都会继续下去。“我们会向北京高等法院上诉，这个过程本身能够推动中国的进步，在中国的法制史上留下一个脚印。”</P>
<P><STRONG>案件曝光后 当局压力大</STRONG></P>
<P>郑恩宠并指出，法院既然花了一年时间才立案，说明法院对这个案件是非常慎重的，甚至请了其他专家来研究，随后公安部也作出应诉，说明北京中院愿意将这个案子进行下去。但现在短短几天后，就裁定驳回，郑恩宠分析，可能是因为案件在媒体曝光后，在国内外引起很大关注，令中共当局被迫要收回此案。</P>
<P>郑恩宠说：“我个人分析，这个案子被公开之后，受到舆论监督，北京第二中级人民法院已经控制不了这个走向。因为国外公开以后，引起了轰动效应，在国内的反响都很大，如果开了这个头之后，告北京市公安部形成一个诉讼潮；第二，大量访民还没有去到北京上访，现在北京带头审理这个案子，到时候其他省市的访民也会在当地告，全国忙不过来，这个问题就大了。所以北京第二中级人民法院不敢承担这个责任，而选择驳回。”</P>
<P>郑恩宠指出，现任政治局常委、前公安部部长周永康被告上法庭，在上海民众中影响很大。郑恩宠和家人在公园里散步的时候，也听到老百姓议论纷纷，说公安部部长周永康都被告上法庭，大家感到乐观；也有北京法律界同行致电给他，赞扬他做了一件好事。</P>
<P>他相信，案件被驳回以及更换被告，估计和周永康施压有关。“周永康现在升做政法委书记，他管的是公检法，法院也属于他管，他肯定给了法院很大压力，要他们把案子撤下去。”</P>
<P><STRONG>望胡温顺民意把案子进行下去</STRONG></P>
<P>案件被驳回上诉，郑恩宠认为，这是胡温的一个败笔，会让老百姓对当权者彻底失望。“这给老百姓看不起，开始不受理，到现在立案后又不受理，老百姓会认为不是搞法制，视同儿戏。童国菁的案件不是一个孤立的案子，起码这两年里面，公安部要负责，公安部没有保护访民上访的权力。”</P>
<P>他认为，胡温应该顺水推舟，顺应民意，把案子进行下去。“就让访民赢一次又怎样呢？访民的上访权力得到保障，也没有那么多冲突事件。这是非常公道的，得人心的事情，如果胡锦涛的智囊团清楚的话，他可以利用这个案子宣布中国走向民主。”</P>
<P><STRONG>郑遭公安传唤七小时</STRONG></P>
<P>另外，8日上午十点郑恩宠再次被上海闸北区公安传唤，至下午五点二十才被放回。这是继今年6月郑恩宠被剥夺政治权力一年期满后，所遭受的第11次传唤。</P>
<P>郑恩宠表示，和以往不同的是，这次公安没有解释任何理由，前面5个小时都是让郑恩宠坐冷板凳，至最后两小时才有一名自称是市公安局国保科的魏涛，和郑恩宠谈话。但谈话内容东拉西扯，明显在拖时间，无事找事，而最后对方自己写了笔录，要郑恩宠签字，郑恩宠要求自书又被拒绝，郑恩宠于是写到：“您写的东西我不承认的。你不给我写，以上的笔录我已经看过，不符合真实性，我要求自书，你不给我自书。”</P>
<P>对于这次被传唤，郑恩宠分析可能有两个原因，一是周正毅案刚刚审结，香港东方日报和瑞士有线电视台前一日都有打电话约他采访，可能当局想阻止他接受采访；另外，就是和周永康被诉案有关，可能上海当局想借传唤给郑恩宠施加压力。<BR></P></font></td>
