<p style="text-indent: 22pt; line-height: 200%"><font color="#333333">上海软件工程师叶达一(化名)近日起诉中国电信，已被上海浦东新区法院受理，将于下周二(29日)上午9点开庭。该案引发广泛共鸣，获众多网友声援。有网友将之誉为由于网络封锁而起诉中国电信的第一案。

<P></P>叶达一25日接受大纪元采访时表示，“关爱是我提起这个诉讼最根本的驱动力。我不能容忍太多人的权利受到侵害。”
<P>“希望这个官司能成为一个真正的公益官司，中国的公民们能真正关心自己的权利，不要太害怕去当出头鸟，要增强公民权利意识。所有的中国公民们都拿全体公民的事当自己的事，那么在强大的媒体和公众的压力下，官商勾结也会变得越来越困难。”
<P><B>网络被封 状告中国电信</B>
<P>叶达一自述，今年2月28日，他发现无法登陆自己做的一个财物软件网站，于是和国外朋友联系，发现他们都能上，通过设置代理服务器也能上。他认为是被电信封锁，因此与对方联络，但来来回回很多次，电信方最后口头告诉他说是“非回复性原因”。
<P>叶达一3月20日向中国电信正式发函申诉，要求得到一个正式的书面回复，解释故障原因，但未得到任何正式回复。叶达一向法院提起诉讼。
<P>叶达一将他的申诉上传到国内的很多网站，但很快就被删除，有网管告诉他说，上海网监部门不让贴。
<P><B>关系到更多人的权利问题</B>
<P>叶达一说，“其实我很早就听说中国的这个长城防火墙计划。我开始还以为，只是过滤一下黄色的或者政治性的东西，没想到现在对于我个人的软件网站都封。”
<P>对于被封锁的可能原因，叶达一表示，“不是他们技术上的故障，就是他们发神经。”
<P>当记者问：网站被封后，是否考虑过另外注册一个域名，换个主机服务商？
<P>叶达一表示，“这不是我的性格，何况，这事往大了说关系到全国人民的权利问题，关系到民主问题。我愿意相信全世界人民的良知，如果，我能就这个问题提起一个公益诉讼，争取到国际国内媒体和公众的支持，我相信我不会输。”
<P><B>网站已通 仍要继续上诉</B>
<P>叶达一表示，根据网友的反馈和自己的验证，自己的那个财物软件网站自5月22日起已经可以访问了。他说，“我猜应该是电信迫于广大网友压力的结果”。
<P>对于网站恢复后是否会考虑撤诉，叶达一表示，“网站已开通不等于说我会撤诉，没有明确的公开的网络监管流程和法制，不公正的网络监管仍然是不可避免的。从官司技术的角度说，我的证据都是经过公证了的，这些证据表明确实有很长一段时间访问不了，所以我仍然有本钱和对手把道理讲下去。”
<P><B>关爱是最根本的驱动力</B>
<P>对于为何提起此诉讼，叶达一表示，“关爱是我提起这个诉讼最根本的驱动力。我爱中国，我爱全世界人民。我不能容忍太多人的权利受到侵害。”
<P>叶达一向支持和关注此案的各界人士表示感谢。他说，“很多网友很支持，甚至希望能捐钱捐力。目前最重要的是，大家的支持，这是我们获得媒体关注、获得话语权的一个很重要的基础。帮助本案的任何信息传播都是对本案的最大支持。”
<P><B>网友：你是第一个这么干的。</B>
<P>数百网友向叶达一表示了支持和鼓励，有网友将之誉为由于网络封锁而起诉中国电信的第一案。
<P>“这件事不容易，你是第一个这么干的。你太有勇气了！支持！中国需要你这样的人！”“支持！太佩服你的坚持和勇气了！”
<P>“强烈支持！有了第一就有第二，希望有更多人跟进。GFW明显的损害了网民的权利，一定要让它认错！”“我是中国人，我支持你！好多人也都在支持你，我就是看了网上的转帖才知道这里的！你做的这件事非常有意义。”
<P><B>网友：无论胜败，你都是一个英雄</B>
<P>“支持你！！官司结束后，无论胜败，你都是一个英雄！！”“不管最终判决如何，此举都将成为中国互联网史上最浓墨重彩的一笔。”
<P>“非常赞赏你的精神，虽然得到想要的结果的可能性微乎其微，但毕竟可以让更多的人来关注这个问题。”“支持！已通过邮件转发。不论最终结果如何，您都是一个榜样人物！真诚地希望：成为先驱而不是先烈。”
<P><B>网友：保持沉默是不道德的</B>
<P>“强烈支持你。不管结果是什么，你这么做都很有价值。在碰到糟糕规则的时候，表明态度是必要的，无论对当事人还是旁观者。这个时候，保持沉默是不道德的。”
<P>“严重支持! 在GFW面前太多人选择屈服，妥协，或是发牢骚、谩骂（包括我自己）。终于见到有人拿起法律武器捍卫我们的权利啦。谢谢，祝你成功！”“祝你好运！希望你把官司进展详细记录在这里，这些记录都将成为未来某一天人民手里的证据。”
