<p style="text-indent: 22pt; line-height: 200%"><font color="#333333"><P>2006年8月12日，北京市中关村一名卖烤肠的小商贩、农村退伍军人崔英杰，为向城市管理执法人员抢回赖以维生的三轮车，意外杀死执法人员。该案一度成为互联网的焦点话题。12月12日，崔英杰以涉嫌“故意杀人罪”和“暴力妨害执法”在北京市一中院开庭受审。</P>
<P>在此案即将判决，崔英杰可能遭处死刑的时刻，同情崔英杰的公众再度掀起舆论高潮，群起疾呼“刀下留人”。包括专家学者在内的众多人士认为问题出自于制度杀人。有网民表示：“可爱的军人、可爱的钢铁长城，在为国家奉献之后，却被生活逼成了‘凶手’……”</P>
<P>崔英杰的父亲崔瑞武2月7日接受大纪元采访时表示，他近日收到全国各地、各行各业的很多人的来电来信，对此事表示关注，并无偿提供经济、法律、舆论等各方面的援助。他向大家表示感谢，同时疾呼当局无罪释放崔英杰。</P>
<P>崔瑞武沉痛的说，“孩子如果真是一个杀人犯，我并不心疼，杀人应该偿命。但问题不是这么回事。现在的世道太乱，官方也太不像话，我们普通老百姓真是没有活路……”</P>
<P><STRONG>优秀士兵</STRONG></P>
<P>据崔瑞武介绍，年仅23岁的崔英杰生性忠厚善良，从小就是个好孩子，经常帮助别人，懂事听话，学习成绩优秀，但由于家境贫寒，初中毕业后辍学参军，曾经获得“优秀士兵”头衔，后来还被提拔位为士官。</P>
<P>他说，“他从来不跟我们提起他这些荣誉，出事后，我们在他的箱子里找相片时，才无意中发现他的优秀士兵证和奖章等。他退伍后到北京谋生，还给别人献过血。律师后来找到他的同事作备录后我们才知道：他自己没钱，但还时常给以前的战友们寄钱，还给流浪街头的孤儿资助。”</P>
<P>据崔瑞武说，崔英杰到北京后，先在北京科贸大厦干了三个月的保安，一直没有拿到工资，无奈卖起烤肠。去年八月案发前，借钱买了一辆做买卖的三轮车。</P>
<P>崔英杰的母亲说，“我那小子非常正直。这个社会，胡搞的人很多，但他很正，从来不胡搞。从没有偷过抢过，一直是靠双手挣钱改变生活。去年6、7月份，他回家一趟，跟我商量，说单位发不出工资，想做个小买卖。后来，他就晚上上夜班，白天卖烤肠，日子过得很辛苦……”</P>
<P><STRONG>事发过程</STRONG></P>
<P>据崔瑞武介绍，崔英杰在开庭时表示，案发当天，他摆摊不到20分钟，突然一群不明身份的人围上他的摊贩，一不作任何解释，二不出任何证件，三不说明身份，“上来就抢我的车”。</P>
<P>崔瑞武说，“在三轮车被扣之后，崔英杰曾跪地求情，乞求城管还他赖以谋生的三轮车。城管不仅置之不理，还表示要痛打他一顿。他见势不妙，撒腿就跑。一群城管在后面追打。其中副队长李志强跑得最快，抓住崔英杰，崔英杰急于脱身，推了李志强一把，手中的小刀也随之划了过去。崔英杰1米78的个儿，李志强1米75，小刀正好划到李志强的脖子上。崔英杰当时并不知道划到脖子了，刀出鞘后他就继续跑了。”</P>
<P>崔瑞武表示，法庭上也播放了案发时的录影带，但是经过剪辑的，一共就出现4个追赶的镜头，既没有开始的镜头，也没有杀人的镜头，所以说明不了什么问题。他说，“既然照到了跑的镜头，为什么没照到杀的镜头呢？！这说明什么问题呢？！”</P>
<P><STRONG>被逼上绝境</STRONG></P>
<P>崔英杰起初被公安局定为“故意伤害罪”。11月27日，北京市检察院一分院以“故意杀人罪”对崔英杰提起公诉。12月12日，崔英杰在市一中院开庭受审，检方同时提出崔英杰存在暴力妨害执法的行为，因而建议法院对他从重处罚。</P>
<P>崔英杰的辩护律师在庭上表示，崔英杰与被害人李志强素不相识、无冤无仇，崔的行为是在挽救自己三轮车的同时，担心自己人身可能受到强制，急于脱身时一次随便的挥刀。崔英杰并没有故意杀人的动机，因此“故意杀人罪”也不存在。执法人员必须是真正的执法人员在执行任务，但是城管有的是被雇佣的、有的是保安，不算是执法人员，也没有出示证件，因此，“妨碍执行公务罪”不成立。</P>
<P>律师还向法庭提交了他的优秀士兵证以及家乡父老为他写的求情信，并说，崔英杰“被生活所迫，从事这样一份卑微贫贱的工作，生活窘困，收入微薄……贩夫走卒、引车卖浆，是古已有之的正当职业。我在法庭上庄严地向各位发问，当一个人赖以谋生的饭碗被打碎，被逼上走投无路的绝境，将心比心，你们会不会比我的当事人更加冷静和忍耐？”</P>
<P>他还强调，“我们的法律、我们的城市管理制度究竟是要使我们的公民更幸福还是要使他们更困苦？我们作为法律人的使命是要使这个社会更加和谐还是要使它更惨烈？我们已经失去了李志强是否还要失去崔英杰？”</P>
<P><STRONG>制度是悲剧之源</STRONG></P>
<P>有关专家认为，公民个人要摆摊贩，政府没有权利禁止他们的经营活动，政府只有权限管理小贩不影响交通、合不合卫生标准等，从大背景考虑崔英杰案，就不应严惩。</P>
<P>网络评论人士指出，此类悲剧的根源在于制度。城管是一个具有“中国特色”的不伦不类的怪胎，是一个没有执法主体的却在行使执法权的组织，是一个没有法理依据的非法机构。只有合理的社会联动机制的正常运行，才能避免类似事件的再次发生。</P>
<P>许多网民认为对崔英杰判死刑，就是对弱势群体判刑。“将一个小贩仅有的并且是借钱买来的谋生而且他尽力要予以保护的工具弄到卡车上去的过程难道不是一个暴力手段吗？” </P>
<P>一名网友在一篇题为“拯救一个叫崔英杰的人-那就意味着我们在拯救自己”的帖子呼吁道：“拯救崔英杰，不仅仅是拯救一条被制度推向绝路的鲜活生命，更重要的是要为像崔英杰为代表的弱势群体“讨回”《宪法》赋于我们的一切权利……今天我们要拯救崔英杰的生命，同时也就拯救我们的灵魂和良心……”</P>
<P>“如果说崔英杰在某些人眼中是个十恶不赦的杀人犯，那么我们都是潜在的杀人犯。在我们眼里，崔英杰不过是个被恶势力逼急了铤而走险的善良的普通人。”</P>
<P>“宝马压人不死，强拆杀人不死，恶警还有不知什么身份的城管打杀小贩不死，小民给断了生路暴起反抗就死……”。<BR></P></font></td>
